Highlights for Wednesday, 12 March 2008

The fifth meeting of the Open-Ended Ad Hoc Working Group of Legal and Technical Experts on Liability and Redress (hereafter, the Working Group) opened in Cartagena de Indias, Colombia, on Wednesday morning.

The Minister of Environment, Housing and Territory Development, Juan Lozano (Colombia), welcomed delegates to the “beautiful and historic” city of Cartagena and said the desire for results would guide the Working Group’s tasks.

Dane Ratcliff, legal counsel for the Permanent Court of Arbitration (PCA), made an expert presentation on settlement of claims and answered questions relating to options for liability and redress under the Biosafety Protocol.

Co-Chair René Lefeber then opened the floor for reflection and comments on the feasibility of adopting various types of instruments. In the ensuing discussion, delegates stated their preferences for various approaches and indicated areas of flexibility.

In the afternoon, the meeting was adjourned to give delegates time for regional coordination and bilateral meetings with the Co-Chairs.

WG Co-Chair Jimena Nieto (Colombia), said the session represented the last chance to deliver on proposed rules and procedures for liability and redress before reporting to COP/MOP 4 in May 2008, in Bonn.
Charles Gbedemah (CBD Secretariat), on behalf of Ahmed Djoghlaf, CBD Executive Secretary, acknowledged progress made during WGLR 4 that resulted in a streamlined and comprehensive working document.
Juan Lozano, Minister of Housing, Environment and Territory Development (Colombia), drew attention to the need to reconcile development and the conservation of biological diversity.
