Eighth meeting of the Ad Hoc Open-ended Working Group on Access and Benefit-sharing of the Convention on Biological Diversity (CBD ABS 8)

Summary Highlights of the Meeting:

The eighth meeting of the Ad hoc Open-ended Working Group on Access and Benefit-sharing (ABS) of the Convention on Biological Diversity (CBD) continued the negotiation of an international regime on ABS. Delegates addressed operative text on the components of the regime, including traditional knowledge, capacity building, compliance, benefit-sharing and access. A discussion on the legal nature of the regime was held in plenary and was reflected in the report of the meeting. The meeting adopted the Montreal Annex, consisting of a consolidated draft on the international regime, and a second annex on proposals for operational texts left in abeyance for consideration at the next meeting of the Working Group. The Working Group also established an intersessional process leading up to ABS 9, consisting of two distinct meetings: a Friends of the Co-Chairs group to convene in late January 2010; and a Co-Chairs' inter-regional informal consultation to convene in March 2010. ABS 9 is then scheduled to be held from 22-28 March 2010, in Cartagena, Colombia.

It is recalled that, in accordance with COP Decision IX/12, the Working Group is instructed to finalize the international regime and to submit for consideration and adoption by COP 10 an instrument/instruments to effectively implement the provisions in Article 15 and 8(j) of the Convention and its three objectives. COP 10 will be held from 18-29 October 2009, in Nagoya, Japan.

The closing plenary convened at 11:00 am. The Working Group adopted the report of the meeting, the Montreal Annex including a consolidated draft on the international regime, and a second annex on proposals for operational texts left in abeyance for consideration at the next meeting of the Working Group. The Working Group also established an intersessional process leading up to ABS 9, consisting of two distinct meetings: a Friends of the Co-Chairs group to convene in late January 2010; and a Co-Chairs' inter-regional informal consultation to convene in March 2010.

CBD Executive Secretary Ahmed Djoghlaf highlighted that the establishment of an intersessional process, along with the development of the Montreal Annex, have elevated the Working Group to an “Intergovernmental Negotiating Committee” for negotiations of the Nagoya international regime.

Jochen Flasbarth, on behalf of the German COP Presidency, highlighted success in producing a comprehensive negotiating text and a roadmap with a well-designed sequence of consultations, noting that everything is in place to consolidate the text of a protocol for adoption at COP 10.

Friday morning was dedicated to regional consultations and inter-regional discussions with the Working Group Co-Chairs on nature and the intersessional process to follow ABS 8. An afternoon plenary reviewed progress and addressed procedural issues. Contact groups on capacity building, compliance, and benefit-sharing and access met in the afternoon and evening.

The Working Group met in a morning plenary to hear progress reports from the contact groups on traditional knowledge, capacity building and compliance, and to address procedural issues. Contact groups on benefit-sharing and access, and on capacity building met throughout the day. An afternoon plenary reviewed progress. Contact groups on traditional knowledge and on compliance met in the evening.

The Working Group met in a morning plenary to hear text proposals on compliance, benefit-sharing, and access. Delegates then established contact groups on traditional knowledge and capacity building, to engage in consolidating and integrating text to form the basis of later negotiations. The groups met throughout the day and into the evening.

Delegates to the eighth meeting of the Ad Hoc Open-ended Working Group on Access and Benefit-sharing (ABS) of the Convention on Biological Diversity (CBD) met in plenary throughout the day to continue negotiations on an international regime on ABS. In the morning, they discussed the legal nature of the regime. In the afternoon, they addressed traditional knowledge, capacity building, and compliance.
